Dear fellow Browncoats-
It has been my pleasure to make and distribute the Jayne repro
shirts to many of you literally the world over. Through great
organizations such as the So Cal, San Fran, and South East
Browcoats, our shirts have been used to raise money for charity at
Comic Con and Wonder Con for the past two years . Today, I recieved
a letter from Fox Corporate "asking" us to stop producing anything
related in any way to the Firefly Series. We do not compete with
them for any business, since the only thing Firefly related they
sell as far as I can tell the DVD set. It is my hope to contact Fox
to try to work out some sort of licencing agreement with them, but
since they apparantly care nothing for the series or the fans that
they abandoned, I am sceptical that they will allow us to continue
in any fashion- if anyone knows of any other contacts that I can use
to help negotiate with them, it would be appreciated, otherwise, I
will go back to other business- They have given me 2 weeks to cease
production, so if anyone is needing anything, please let me know as
soon as possible...........

i think you need to find a way to go around the clause, puttin serenity or firefly on the shirts may be an issue but copying a graphiuc tee??? i dont think so,...
it does seem like they are claiming ownership of costume designs, and I wonder if a court would actually uphold that... after all there are copies of coats,...
They might not be able to claim copyright on generic items like guns, vests, etc., but they could claim that any artistic designs like the Blue Sun logo were...
There seems to be a lot of confusion out there as to what are copyright issues and what are trademark issues. They are arcane and complicated (which is why I...
Hi! I'm just curious, why wouldn't they just be like Jayne and request a cut up front rather than issue a cease and desist? If something is successfully...
While as a practical matter you are correct, I am afraid that as a legal one it is not quite right. They actually have to ask him to "cease and desist" so that...
In true Browncoat fashion I'd suggest you just take it underground and sell it on Cafepress.com or something that's not so easily linked back to you. Sure...
Might be too late for that once you get a C&D letter. Even giving it away is a problem as it is not about profit but brand integrity and control. ... ...
Agreed. Once you get the C&D, if you keep producing the product, even somewhere else, it's kind of hard to take the high road, or to claim ignorance. And to go...

Wouldn't they have to check every single stitch to make sure it was the same hat? That it had the same diameter? Or even the same string? It isn't like it's...
I doubt it. I suspect that all the Jayne hats us Browncoats wear are violations of copyright, so "isn't this just like Jayne hats?" is not a reason for trying...

I don't think that they should be copyright violaions. That's like saying if I wear a blue shirt and khaki pants, I'm violating the wardrobe copyright of the...
Hm. I don't know. If they bought it off the hook, I would agree, but if they made something unique(?), then ... I don't know. The specific colour scheme and...
... Maybe color choices? But you could of found that pattern complete with tie unders available before Jayne sported one. I would think that if a company...
The hat might look generic but the specific design is protectable. You cannot copyright an idea - such as a black trench coat - but you can protect how that...
... Either that or there would be quite a few grandma's that should be contacting Fox about copyright violations against hats they have been making for...
This is actually trademark stuff mostly but I understand what you are saying. The answer is no because if the average reasonable person could be confused as to...
I've received a number of replies off-list wanting more information about this copyright/trademark stuff. Shall we have a seminar? I usually charge for these ...
